For Foreign Buyers

Buying in Phuket as a Foreign National

A focused legal, tax, visa and lifestyle briefing tailored to this property and its location. Information is general guidance — InDreams Phuket recommends consulting a Thai-licensed lawyer before signing any reservation agreement.

01

Property Ownership Rules

Leasehold Villa Ownership (30+30+30)

Foreigners cannot directly own land in Thailand. For this villa, the standard structure is a registered 30-year leasehold with two contractual 30-year renewal options, plus full freehold ownership of the building (the structure itself).

  • Lease is registered at the Land Office and noted on the title deed (Chanote).
  • Building / structure can be owned in the foreigner's name via a separate construction permit.
  • Alternative routes: Thai limited company ownership, BOI-approved investment, or a Thai-national long-term partner.

Investment Returns

Typical net yield (area average)
60–70%
Annual income earned in Nov–Apr high season
8–12 yrs
Typical payback for well-managed rental units

Net rental yields in Phuket\'s prime west-coast areas typically range from 5% to 8%, depending on location, building age, management quality and seasonal occupancy. Capital appreciation in the same areas has historically averaged 5–7% per annum.

03

Tax & Fees for Foreign Buyers

Transfer Fee
2.0%
Of the government-appraised value. Most commonly split 50/50 between buyer and seller, but this is negotiable per contract.
Specific Business Tax (SBT)
3.3%
Applies if the seller has held the property for less than 5 years. Usually paid by the seller.
Stamp Duty
0.5%
Paid only if the SBT does not apply. Typically the seller's responsibility.
Withholding Tax
1–3%
Calculated on a progressive scale based on the seller's holding period. Always paid by the seller, never by the buyer.
Annual Land & Building Tax
0.02–0.10%
On the appraised value; rates depend on use (residential vs. commercial / leased).
Gift Tax
5%
Applies on transfers above 20 MTHB to non-relatives. Inheritance tax is 5% (descendants) or 10% (others) on estate value above 100 MTHB.

Total combined closing costs for a foreign buyer typically fall in the 3–5% range of the purchase price, depending on the deal structure and how transfer fees are split. InDreams Phuket can request a written closing-cost estimate from our partner law firm before you commit.

Lifestyle for Expats in Naithon beach

Nai Thon is one of the last properly quiet beaches on the Phuket west coast. The bay sits inside the Sirinat National Park buffer, which has kept large-scale development out and left a narrow village strip facing a clean, swimmable beach. Most foreign residents here are not first-time arrivals: they tend to be retirees, returning travellers and families looking specifically for low density living. The trade-off is straightforward. You get a calm beach, jungle hills behind, almost no traffic, and a 10 to 15 minute drive to Phuket International Airport. In exchange you accept that the international schools, Boat Avenue and the large hospitals are 20 to 30 minutes south, which makes a car or scooter essentially mandatory. Day to day, life revolves around the village strip: a row of beachfront restaurants, a couple of small mini-marts, dive shops and yoga studios. Nai Yang, five minutes south, adds a Thai night market and the Marriott and Slate resort hubs for weekend dining. Healthcare is the main thing to think about: there is no large private hospital in the immediate north, so most expats register with Bangkok Hospital Phuket and rely on its ambulance network. For buyers, Nai Thon attracts those who specifically reject the Bang Tao density, and the rental yield profile is different, with strong high-season occupancy and a softer green season.

International Schools
  • UWC Thailand International School 13 km
  • British International School Phuket (BISP) 18 km
  • HeadStart International School (Cherngtalay campus) 15 km
  • Berda Claude International School 16 km
Expat Community

Nai Thon village strip (beachfront cafes, mini-marts, dive shops); Nai Yang village 5 km south for night market and casual dining; Boat Avenue and Porto de Phuket (about 15 km, 20 minutes south); Phuket International Airport area for chain supermarkets.

Healthcare

Thalang Hospital — public (10 km); Bangkok Hospital Phuket (30 km); Mission Hospital Phuket in Phuket Town (32 km). Note: no large private hospital on site; ambulance transfer to Bangkok Hospital Phuket is the standard route.

Beach Clubs & Dining

Andaman Restaurant Nai Thon (beachfront), Coco Beach Restaurant Nai Yang, The Slate beach restaurants at Nai Yang, Phuket Marriott Resort and Spa Nai Yang beachfront bar, Trisara private beach restaurant (between Nai Thon and Layan).
