Layan Beach — Phuket Area

Infrastructure

Gorgeous Layan beach is located in the northwest part of the island. It is considered by many to be part of Bangtao beach, but it is indeed an independent beach located on the outskirts of Sirinath National Park.

It is difficult to determine its length, as there is no clear border between it and Bang Tao. In the northernmost part of Layan, you can find a small island right off the coast - during low tide, you can actually walk to it along the sandbank. The picturesque Kala River flows into the sea at the

Layan Beach — Phuket area for living and investment

Layan is an exclusive area on Phuket's northwest coast, bordering Sirinat National Park. It is one of the island's quietest and most private districts, dominated by premium villas on large land plots.

Layan Beach — the northern continuation of Bang Tao Beach — is less crowded and more natural. Nearby are mangrove forests, canals, and green hillsides. The area attracts those seeking seclusion, large land plots, and proximity to nature.

Villas in Layan start from 25 million THB ($700,000) and reach over 300 million THB for panoramic sea-view estates. Condominiums start from 8 million THB ($225,000). Average plot sizes are 800-2,000 sqm, larger than in any other coastal area.

The airport is just 15 minutes away (the nearest beach to the airport), Bang Tao is 10 minutes. Advantages include maximum privacy, large plots, and proximity to both the airport and the national park. Drawbacks include minimal infrastructure (restaurants and shops are in Bang Tao).

For Foreign Buyers

Buying in Layan Beach as a Foreign National

A focused legal, tax, visa and lifestyle briefing for foreign buyers considering property in Layan Beach. Information is general guidance — InDreams Phuket recommends consulting a Thai-licensed lawyer before signing any reservation agreement.

01

Property Ownership Rules

Freehold Condominium Ownership

Foreigners can hold a condominium unit as 100% freehold in their own name, provided the project remains within the 49% foreign ownership quota under the Thailand Condominium Act B.E. 2522. Ownership is registered at the Land Office and the title (Chanote) is issued directly to the buyer.

  • Funds for the purchase must be remitted from abroad in foreign currency.
  • A Foreign Exchange Transaction (FET) form is required from the receiving Thai bank.
  • Ownership is permanent, inheritable, and freely transferable to another foreigner.
Leasehold Villa Ownership (30+30+30)

Foreigners cannot directly own land in Thailand. For villas and houses, the standard structure is a registered 30-year leasehold with two contractual 30-year renewal options, plus full freehold ownership of the building (the structure itself).

  • Lease is registered at the Land Office and noted on the title deed (Chanote).
  • Building / structure can be owned in the foreigner's name via a separate construction permit.
  • Alternative routes: Thai limited company ownership, BOI-approved investment, or a Thai-national long-term partner.

Capital appreciation in established areas has historically averaged 5–7% per year. Individual projects in Layan Beach may offer contractual rental programmes with developer-guaranteed returns — see each property listing for project-specific terms.

03

Tax & Fees for Foreign Buyers

Transfer Fee
2.0%
Of the government-appraised value. Most commonly split 50/50 between buyer and seller, but this is negotiable per contract.
Specific Business Tax (SBT)
3.3%
Applies if the seller has held the property for less than 5 years. Usually paid by the seller.
Stamp Duty
0.5%
Paid only if the SBT does not apply. Typically the seller's responsibility.
Withholding Tax
1–3%
Calculated on a progressive scale based on the seller's holding period. Always paid by the seller, never by the buyer.
Annual Land & Building Tax
0.02–0.10%
On the appraised value; rates depend on use (residential vs. commercial / leased).
Gift Tax
5%
Applies on transfers above 20 MTHB to non-relatives. Inheritance tax is 5% (descendants) or 10% (others) on estate value above 100 MTHB.

Total combined closing costs for a foreign buyer typically fall in the 3–5% range of the purchase price, depending on the deal structure and how transfer fees are split. InDreams Phuket can request a written closing-cost estimate from our partner law firm before you commit.

Lifestyle for Expats in Layan Beach

Layan is the northern continuation of Bang Tao Beach, separated by a small canal and a forested headland. The character changes immediately. Where Bang Tao has beach clubs and a busy main road, Layan is residential, low density and dominated by the Anantara Layan resort, a handful of branded villa estates and large private homes hidden behind walls in the hills. Foreign residents here tend to be at the higher end of the market and lean towards families with school-age children who want UWC or BISP within a ten minute drive but prefer not to live on top of Boat Avenue. The beach itself is short, shaded by casuarina trees, and has a fishing community at the canal mouth that keeps the atmosphere local rather than resort-styled. There are no large nightclubs and only a few restaurants directly on the sand, with the Beach House at Anantara as the main beachfront option. For daily errands most Layan residents drive south to Cherngtalay and Boat Avenue, which puts groceries, clinics, cafes and the Friday night market within four kilometres. Healthcare follows the same pattern as Bang Tao, with Bangkok Hospital Phuket the main private facility in town. Layan suits buyers who want green surroundings, larger plots, beach access without crowds, and the lifestyle of the Cherngtalay corridor with one extra layer of quiet.

International Schools
  • UWC Thailand International School 3 km
